PRIVACY POLICY OF THE ONLINE SHOP

§ 1 GENERAL PROVISIONS

  1. The administrator of personal data collected through the online shop www.fugo-group.com is FUGO GROUP spółka z ograniczoną odpowiedzialnością (limited liability company), entered into the Register of Entrepreneurs by the District Court for the Capital City of Warsaw in Warsaw, XII Commercial Division of the National Court Register under the number: 0000759296, place of business and address for service: ul. Modularna 11a/hala 2, 02-238 Warsaw, NIP: 5213847504, REGON: 381876910, e-mail address: sales@fugo-group.com, hereinafter referred to as the "Administrator" and also being the "Service Provider".

  2. Personal data collected by the Administrator through the website are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR.

  3. All words or expressions written in this Privacy Policy with a capital letter should be understood in accordance with their definition contained in the Terms and Conditions of the online shop www.fugo-group.com.

§ 2 TYPE OF PERSONAL DATA PROCESSED, PURPOSE AND SCOPE OF DATA COLLECTION

  1. PURPOSE OF PROCESSING AND LEGAL BASIS. The Administrator processes the personal data of the Service Recipients of the shop www.fugo-group.com in the case of: a) Account registration in the Shop, in order to create and manage an individual account, based on Art. 6(1)(b) of the GDPR (performance of a contract for the provision of electronic services in accordance with the Terms and Conditions). b) Placing an order in the Shop, in order to send a proforma invoice and conclude a sales agreement, based on Art. 6(1)(b) of the GDPR (performance of a sales agreement). c) Subscribing to the Newsletter for the purpose of sending commercial information by electronic means. Personal data are processed after expressing separate consent, based on Art. 6(1)(a) of the GDPR.

  2. TYPE OF PERSONAL DATA PROCESSED. In the case of: a) Account: Name and surname, Login, Address, E-mail address. b) Order: Name and surname, Address, Tax ID (NIP), E-mail address, Phone number. c) Newsletter: Name and surname, E-mail address.

  3. DATA ARCHIVING PERIOD. Personal data of Service Recipients are stored by the Administrator: a) Where the basis for processing is the performance of a contract: as long as it is necessary for the performance of the contract, and thereafter for a period corresponding to the limitation period for claims (usually 3 or 6 years). b) Where the basis for processing is consent: until the consent is withdrawn, and after the withdrawal of consent for a period corresponding to the limitation period for claims.

  4. While using the Shop, additional information may be collected (IP address, domain name, browser type, access time, operating system).

  5. Navigation data (links, clicks) may be collected based on the legitimate interest of the Administrator (Art. 6(1)(f) of the GDPR) to improve the functionality of services.

  6. Providing personal data is voluntary.

§ 3 SHARING OF PERSONAL DATA

  1. Personal data of Service Recipients are transferred to service providers used by the Administrator, in particular to: a) Logistics companies (delivery of Products). b) Payment system providers. c) Accounting office. d) Hosting provider. e) Business software providers (accounting, shop systems). f) Mailing system providers.

  2. Personal data are stored exclusively within the European Economic Area (EEA).

§ 4 RIGHT OF CONTROL, ACCESS AND RECTIFICATION

  1. The data subject has the right to access their data, rectify them, delete them, limit processing, the right to data portability, the right to object, and the right to withdraw consent at any time.

  2. To exercise these rights, an e-mail can be sent to: sales@fugo-group.com.

  3. The Administrator will fulfill or refuse the request without delay, no later than within one month of receiving it.

  4. The data subject has the right to lodge a complaint with the competent supervisory authority (UODO).

§ 5 COOKIES

  1. The Administrator's website uses "cookies". These are necessary for the correct functioning of the page and for statistical purposes.

  2. Two types are used: "session" (temporary) and "persistent" (stored for a set period).

  3. The Administrator uses own cookies to analyze user interaction and external cookies (e.g., Google Analytics) for anonymous statistics.

  4. The User can manage or disable cookies through their browser settings.

§ 6 ADDITIONAL SERVICES AND SOCIAL PLUGINS

  1. The Shop uses social plugins (Facebook, Instagram, YouTube, Google). When visiting the site, the browser establishes a direct connection with the servers of these providers.

  2. The Administrator uses remarketing tools such as Google AdWords. The User can manage these options in the cookie settings.

§ 7 FINAL PROVISIONS

  1. The Administrator applies technical and organizational measures to ensure the protection of personal data against unauthorized access, loss, or destruction.

  2. In matters not regulated by this Privacy Policy, the provisions of the GDPR and relevant Polish laws shall apply.
